The U.S. Department of Justice has filed a federal complaint against Chattanooga’s Erlanger Hospital. According to the complaint Erlanger knowingly billed Medicare for hospital services referred by its physicians between 2014 to at least 2021, in violation of federal law. 2 former Erlanger executives, former Chief Compliance Officer Alana Sullivan and former Chief Financial Officer Britt Tabor, filed a federal lawsuit back in April 2021. The document was recently unsealed this recently. Sullivan and Tabor claim Erlanger filed false insurance claims using the illegal self-referral process to government payers, including Medicare and Medicaid. That would be a violation of the federal anti-kickback statute known as the Stark Law. The lawsuit says the claims were false because the claimants weren’t in fact eligible for reimbursement.
